MOBILE BANKING TERMS AND CONDITIONS OF USE

Please read these Terms and Conditions (“Terms”) carefully before downloading, accessing, installing, or using the Solution Savings and Credit Co-operative Society Limited (“Solution Sacco”, “Sacco”, “we”, “us”, “our”) Mobile Banking Application (“App”, “Mobile Application”, “Service”). The App is developed by Binary Limited and is offered in conjunction with other authorized service providers. These Terms, together with our Privacy Policy, constitute a legally binding agreement between you and Solution Sacco governing your use of the Service. 

 

  1. Acceptance of Terms

By downloading, installing, browsing, or using the Mobile Banking Application, you acknowledge that you have read, understood, and accepted these Terms and our Privacy Policy, which is incorporated herein by reference.  

We reserve the right to amend these Terms at any time.  

Your continued use constitutes acceptance of the amended Terms.  

If you do not agree to be bound by these Terms, you must immediately cease use of the Mobile Application and uninstall it. 

You must be at least eighteen (18) years of age to use this App. If you are under 18, you are not permitted to use the Service. 

 

  1. Definitions

Unless otherwise required by the context, the following terms shall have the meanings assigned to them: 

  • Account: A user-created profile on the Mobile Application. 
  • Apply: The act of requesting Sacco products (e.g., accounts, loans). 
  • Branch: A designated business unit location of Solution Sacco operations. 
  • Guarantor: An individual who accepts legal responsibility for another’s loan. 
  • Next of Kin: The User’s closest blood relative. 
  • OTP: One-Time Password is a unique, time-sensitive, automatically generated numeric or alphanumeric string of characters sent to your mobile number or email address to validate logins or specific transactions. 
  • Password: A confidential PIN or passcode used for authentication. 
  • PIN: Personal Identification Number is a numeric or alphanumeric string used to authenticate a person to a system and authorizing transactions. 
  • Privacy Policy: The policy governing data use as outlined in Clause 10. 
  • Products: Solution Sacco offerings including accounts, loans, and other financial instruments. 
  • Register/Registration: The process of creating an Account/profile on the Mobile Application. 
  • Sacco: Solution Savings and Credit Co-operative Limited and its affiliates. 
  • Services: All digital banking services made available via the Mobile Application. 
  • Transfer of Funds: The movement of money between accounts, internally or externally. 
  • User(s): Any individual who downloads, installs, accesses, or uses the Mobile Application. 

 

  1. General Provisions

3.1 Scope and Use 

  • All use of the Mobile Banking Application and Services is governed by these Terms. 
  • The Mobile Banking Application and Services are intended for personal, non-commercial use within Kenya. Use outside Kenya is at your own risk and subject to applicable local laws. 
  • Business or unauthorized commercial use is strictly prohibited. 

3.2 Access and Restrictions 

We reserve the right to: 

  • Prevent, restrict, suspend, or terminate your access to the Mobile Application or Services at our discretion. 
  • Block transactions or applications inconsistent with these Terms. 
  • Terminate access for violations of these Terms. 

3.3 User Equipment 

You are responsible for: 

  • Providing your own mobile device, data plan, and internet access. 
  • All charges from mobile service providers and third-party platforms (e.g., M-Pesa, utility providers). 
  • Ensuring device compatibility and security. 

 

  1. Services and Features

4.1 Functionality 

The Mobile Application enables Users to: 

  • Register and manage accounts. 
  • Perform internal and external funds transfers. 
  • Apply for loans and access mobile wallets. 
  • Pay utility bills and make merchant payments. 
  • View transaction history and statements. 
  • Request for certain bank services. 

4.2 Third-Party Services 

Use of third-party services (e.g., M-Pesa, billers) via the App is at your sole discretion. We are not responsible for: 

  • Your relationship with third-party providers. 
  • Charges, failures, or losses arising from third-party services. 
  • Device or software malfunctions. 

4.3 Transactions 

You are responsible for: 

  • Ensuring sufficient account balance before initiating transactions. 
  • All transactions carried out using your credentials. 
  • Monitoring your statement of account for transaction records. 
  1. Loan Applications 

You are responsible for all loan applications made on your account using your credentials.  

All loan applications are subject to Solution Sacco Loan Policies and are subject to these Terms. 

We may reject non-compliant applications at our discretion. 

4.5 Restrictions 

  • Prohibited: Reproduction, resale, or commercial use of Products. 
  • No Liability: We are not responsible for: 
  • Negligence by our employees/agents. 
  • Lost/stolen products or samples. 

 

 

  1. Registration and Account Security

5.1 Account Access 

Access to the Service requires successful Registration and authentication via a one-time password (OTP), followed by a confidential PIN or Password of your choosing. 

5.2 Security Obligations 

You agree to: 

  • Keep your User ID and Password confidential. 
  • Prevent fraudulent access to your account. 
  • Notify us immediately of any breach or suspected compromise. 
  • Update credentials promptly in case of device change or suspected credentials exposure. 

We are not liable for: 

  • Unauthorized access due to your negligence. 
  • Loss or compromise of your login details. 
  • Security lapses resulting from third-party devices or software. 

 

  1. User Obligations and Prohibited Use

6.1 General Compliance 

You agree to comply with all applicable Sacco policies as amended. 

 

6.2 Information Accuracy 

You agree to: 

  • Provide true, complete, accurate, and up-to-date information. 
  • Use the Services only as permitted under these Terms. 

 

6.3 Prohibited Conduct 

You expressly agree that you shall not: 

Content Restrictions 

  • Transmit offensive, unlawful, defamatory, threatening or infringing content 
  • Distribute content that is: 
  • Defamatory, blasphemous, or obscene. 
  • In violation of copyright, privacy, or personality rights. 
  • Technically harmful (viruses, malware, etc.). 

Behavioural Restrictions 

  • Cause annoyance, anxiety, inconvenience or needless anxiety. 
  • Intercept communications or overload our systems. 
  • Incite hatred against any group or minority. 
  • Introduce malware, viruses, or harmful code. 

Fraud & Security Violations 

  • Engage in fraudulent, deceptive, or unauthorized activities. 
  • Provide false information. 
  • Intercept or attempt to intercept telecommunications. 
  • Circumvent security measures. 
  • Use monitoring tools to monitor and intercept data. 
  • Impersonate others or hack systems. 
  • Impose excessive load on our system infrastructure. 

General Misuse 

  • Resell Products / Services or exploit content without authorization. 
  • Violate internet best practices. 
  • Restrict others’ access to the Mobile Application or Services. 
  • Use the mobile App for unintended purposes or any unlawful activity. 
  • Use the Mobile Application to violate any law or the rights of others. 
  • Breach these Terms or applicable laws. 

 

6.5 Consequences of Violations 

  • Immediate suspension of your account. 
  • Legal action for damages or breaches. 
  • Reporting to law enforcement (where applicable). 

 

 

  1. Content and License

By submitting any content (including text, images, or materials) via the Mobile Application, you: 

  • Warrant you own or have rights to the content. 
  • Grant us a royalty-free, worldwide, non-exclusive license to use, modify, and reproduce such content for promotional purposes. 

We reserve the right to: 

  • Modify or remove content without notice. 
  • Block access to violating material. 

 

 

  1. Service Availability and Modifications

8.1 Error Resolution 

We will use reasonable efforts to correct notified errors, but we do not guarantee uninterrupted error-free operation. 

8.2 Service Availability 

  • We may suspend, modify, or discontinue any part of the Service without notice. 
  • The App may become inaccessible due to maintenance, security measures, or external factors without notice. 
  • We do not warrant uninterrupted availability. 
  • We reserve the right to update or remove features or content. 

8.3 Security Disclaimers 

  • We are not liable for virus-related or cyberattacks damages. 
  • You use the Mobile App at your own risk. 

 

  1. Alerts and Notifications

By using the Mobile Application, you consent to receive: 

  • Automated notifications, alerts, and confirmations. 
  • Transaction-related and promotional messages.
     

Message frequency may vary and standard carrier charges may apply. 

 

  1. Privacy Policy

Your use of the Service is governed by our Privacy Policy, which outlines: 

  • The types of personal information we collect. 
  • How we use, share, and protect your data.
     

By using the App, you consent to our collection and use of data in accordance with our Privacy Policy, available on our official website. 

 

  1. Termination of Access

You may discontinue use of the App at any time. 

We may, without prior notice or liability, terminate or suspend: 

  • Your access to the Service. 
  • Any part of the Services for maintenance, legal, or operational reasons. 

We shall not be liable to you or any third party for such suspension or discontinuation. 

 

  1. Limitation of Liability and Indemnity

The Service is provided “as is” without warranties of any kind. To the fullest extent permissible by law, we disclaim all liability for: 

  • Unauthorized access to your account. 
  • Device failures or software errors. 
  • Third-party service malfunctions. 
  • Losses arising from security breaches. 
  • Consequences of service termination. 

You agree to indemnify and hold Solution Sacco harmless from any claims, liabilities, damages, or costs arising from your use or misuse of the Service. 

 

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the jurisdiction of Kenyan courts. 

 

  1. 14. Changes to these Terms and Conditions

We may update these Terms from time to time.  Updates will be posted on our website and or in-app. You will be notified of material changes where appropriate via: 

  • In-app notifications. 
  • Email (if applicable). 
  • Updated “Last Revised” date at the beginning of this document. 

You are advised to review these Terms periodically.
